1.1 By accessing extrawings.org (the “Site”) you agree to these Terms of Use. If you do not agree, please do not use the Site.
1.2 Content is provided “as-is,” without warranties of any kind. Extra Wings Corp (“Extra Wings,” “we,” “our”) disclaims all liability for errors or omissions and for actions taken in reliance on information posted here. Nothing on the Site constitutes legal, tax, or investment advice. Seek qualified professional counsel before acting on any information.
1.3 We may link to third-party websites. We do not endorse or assume responsibility for any third-party content.
1.4 Florida law governs these Terms, without regard to its conflict-of-law rules. Jurisdiction and venue lie exclusively in the state or federal courts of Pinellas County, Florida.
2. Tax-Exempt Status & Donation Disclosures
2.1 Extra Wings Corp is a nonprofit corporation incorporated in the State of Florida and recognized by the U.S. Internal Revenue Service as a tax-exempt public charity under Section 501(c)(3) of the Internal Revenue Code (EIN: [insert EIN]).
Contributions to Extra Wings Corp are tax-deductible to the fullest extent permitted by law under IRC §170(b)(1)(A)(vi). Donors are encouraged to consult their tax advisers and retain donation receipts for their records.
2.2 Extra Wings Corp is committed to maintaining full compliance with all IRS requirements for charitable organizations.
If our exemption status is ever modified, suspended, or revoked, we will promptly update this page and notify recurring donors by email.
2.3 No goods or services are provided in exchange for donations unless expressly stated on your receipt. In such cases, only the portion of your contribution exceeding the fair market value of any goods or services received is tax-deductible.
2.4 Refunds: If you believe a donation was made in error, please email us within 30 days of the transaction. Approved refunds will be returned via the original payment method.
3. Third-Party Brands & Intellectual Property
3.1 All trademarks, service marks, and trade names (including Comp Air Aviation®, Textron®, Cessna®, Kodiak®, King Air®, Caravan®) are property of their respective owners. They appear on this Site only to describe aircraft options under consideration; no sponsorship or affiliation is implied.
3.2 The Extra Wings name, logo, and all Site content are our property and may not be used without prior written permission.
4. Forward-Looking Statements
Statements about future aircraft acquisitions, delivery timelines, or fundraising goals are forward-looking and subject to risks, including manufacturing delays, regulatory approvals, and fundraising shortfalls. Actual results may differ materially.
5. Privacy Notice

5.1 Scope. This Notice applies to personal data we collect via the Site, fundraising platforms, email, events, and social media.
5.2 Data We Collect.
• Identification & contact data (name, address, email, phone).
• Donation records.
• Device information, IP address, and cookies.
• Any other data you voluntarily provide (e.g., inquiries, survey responses).
5.3 Purposes. We process data to (i) receive and acknowledge donations, (ii) send receipts and impact reports, (iii) operate and secure the Site, (iv) conduct internal analytics, and (v) comply with legal obligations.
5.4 Legal Bases. Where required, we rely on consent, legitimate interests, the performance of a contract, or compliance with a legal obligation.

5.8 Data Sharing. We do not sell personal data. We share it only with (i) payment processors, (ii) service providers bound by contract, or (iii) authorities when legally required.

6. Donor Transparency & Financial Stewardship
6.1 We publish annual financial statements and project updates on this Site. Large donors may request a site visit to the aircraft assembly facility.
6.2 Funds designated for a specific program will be used for that purpose; however, Extra Wings retains discretion to redirect funds if a project becomes impractical or oversubscribed.
7. Permissible Use & User Conduct
You agree not to: (i) interfere with the Site’s operation, (ii) upload malicious code, (iii) harvest donor data, (iv) use content for commercial purposes without a license.
8. Governing Law & Dispute Resolution
These terms are governed by Florida law. Any dispute shall first be mediated in Brevard County; if unresolved, it shall be submitted to binding arbitration under the AAA Nonprofit Rules.
